These Terms and Conditions govern the sale of artwork by Luay Dababneh
By purchasing artwork through this website (www.luaydababneh.com), you agree to be bound by these Terms and Conditions.
Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions:

  • “Artist”, “we”, “us”, or “our” refers to Luay Dababneh
  • “Buyer”, “you”, or “your” refers to the person purchasing Artwork from the Website.
  • “Artwork” means any original artwork or lifestyle item offered for sale on the Website.
  • “Website” means www.luaydababneh.com or any associated online sales platform operated by the Artist.

2. Acceptance of Terms

  • By placing an order, you confirm that you:
  • Are at least 18 years of age or have permission from a parent or guardian.
  • Have read, understood, and agree to these Terms and Conditions; and
  • Have provided accurate and complete information for your purchase.

3. Pricing and Payment

  • All prices are listed in Australian Dollars (AUD) and include GST, where applicable.
  • Prices may change without notice but will not affect confirmed orders.
  • Payment is required at checkout and is processed through secure third-party payment gateways.
  • We reserve the right to cancel any order if payment is declined or suspected of fraud.

4. Description of Artwork

  • We make every effort to describe each Artwork accurately and represent colours, materials, and details as closely as possible.
    However, due to differences in screen displays and lighting, the actual colours and textures may vary slightly from the images shown online.
    Minor variations are not considered faults.

5. Shipping, Title, and Risk

  • All Artwork ships from Melbourne, Australia.
  • Free shipping is offered to Australia and New Zealand.
  • Domestic orders are sent via Australia Post with tracking and insurance.
  • International orders (outside Australia and New Zealand) are shipped via reliable international couriers with full insurance and tracking.
  • Title and risk in the Artwork pass to you once the Artwork is dispatched from our studio.
  • Buyers are responsible for any customs duties, import taxes, or brokerage fees for international deliveries.

6. Returns and Refunds

  • All sales are final.
    Because each piece is original and hand-crafted, we do not accept returns or offer refunds for change of mind.
  • However, under the Australian Consumer Law (ACL), you are entitled to a repair, replacement, or refund if an Artwork is faulty, damaged during shipping, or not as described.

If your Artwork arrives damaged:

  1. Notify us within 3 days of delivery.
  2. Provide clear photographs of the packaging and the Artwork.
  3. We will arrange a resolution through the shipping insurer, which may include a replacement or refund.

All shipments are fully insured for your protection.

7. Intellectual Property and Copyright

All Artwork, images, and designs on this Website are the intellectual property of Luay Dababneh
Purchasing an Artwork gives you ownership of the physical piece only — not the copyright or reproduction rights.

You may not reproduce, photograph for commercial use, publish, or distribute the Artwork without prior written permission from the Artist.
The Artist retains all moral rights, including the right to be identified as the creator of the work and to object to any modification or misuse.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Artist’s liability for any breach of these Terms or any implied warranty is limited to the replacement or refund of the Artwork.
  • The Artist will not be liable for any indirect, incidental, or consequential loss or damage resulting from the purchase or use of the Artwork.
  • Nothing in these Terms limits your rights under the Australian Consumer Law.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria in relation to any dispute arising under these Terms.

10. Changes to Terms and Conditions

Luay Dababneh reserves the right to modify these Terms at any time.
Any changes will take effect immediately upon posting on this Website.
The date of the most recent update will always appear at the top of this page.
